1. If the seller is a professional (dealership or car dealer)

You are protected by the Consumer Protection Act. The seller is obligated to provide you with a Legal Warranty of at least one year. This warranty covers any «lack of conformity«: breakdowns and defects that do not correspond to what was agreed in the contract or with the expected condition of the vehicle.

2. If the seller is a private individual

The transaction is governed by the Civil Code. There is no warranty as such, but the seller has the legal obligation to respond for six months for hidden defects. A hidden defect is considered a serious defect that existed before the sale and is not visible, which makes the car useless for its purpose or severely diminishes its value.

What can you demand from the seller?

Once the legal framework of your case is determined, these are the remedies you can demand, if necessary through legal proceedings.

Mandatory repair

Force the seller to assume the full cost of repairing the breakdown.

Price reduction

Claim a reduction on the original purchase price, equivalent to what the vehicle has lost in value due to the defect.

Contract termination

This is the most decisive action. It consists of undoing the sale: you return the car and the seller returns the full amount of money you paid.

Vehicle replacement

Applicable only to purchases from professionals. If repair is not viable or effective, you can demand delivery of another vehicle with equivalent characteristics.
